ITC Fights Apple Bid to Rehear Ruling Upholding 2023 Watch Ban

The US International Trade Commission urged the Federal Circuit not to revisit a decision preserving the agency’s 2023 ban on imports of some Apple Watch models.

The ITC argued Apple Inc.'s challenge over Masimo Corp.'s pulse-oximetry patents overstates the ruling’s significance for the agency’s domestic-industry test. Apple also failed to show the narrow circumstances needed for panel rehearing or rehearing en banc, the ITC said Wednesday, responding to Apple’s combined petition in the US Court of Appeals for the Federal Circuit.
