Irving Consumer Products Ltd. escaped potential damages of more than $10.5 million when a federal jury in Delaware found on Friday that bath tissue the JD Irving Ltd. unit supplied to Sam’s Club for sale under the Member’s Mark brand doesn’t infringe three First Quality Tissue LLC patents.
Jurors also agreed with Irving that the patents shouldn’t have been issued because they were anticipated by earlier products including Puffs by Royale, P&G Puffs, Charmin Ultra Soft, and KC Scott Extra Soft, according to the verdict issued in the U.S. District Court for the District of Delaware.
