Invitae Corp. urged a Delaware federal judge to reject Natera Inc.’s request for supplemental damages and an ongoing royalty, after a jury awarded Natera $19.4 million for infringing patents related to personalized cancer-monitoring products.
Judge Gregory B. Williams should defer ruling on Natera’s renewed motion until Invitae’s post-trial motions and any appeals are resolved, according to a redacted version of Invitae’s opposition brief filed Dec. 27 in the US District Court for the District of Delaware. Invitae filed the brief under seal Dec. 20.
