A Florida federal judge denied patent owner Leigh Rothschild and his company Analytical Technologies LLC’s request to rule Baker Botts LLP patent attorney Rachael Lamkin defamed them.
Judge Darrin P. Gayles determined judgment on the pleadings is premature because material facts remain in dispute, including whether Lamkin’s statements in an October Bloomberg Law article are false, according to a paperless order docketed Friday in the US District Court for the Southern District of Florida. The judge also denied Rothschild’s motion to dismiss Lamkin’s abuse of process counterclaim, finding her allegations sufficient.
