Intuitive Surgical Gets Chance to Carve Up Robotic Patents

Intuitive Surgical Inc. will get a stab at proving claims in patents on a process for securing body tissue are invalid, with the Patent Trial and Appeal Board giving the go-ahead for two inter partes reviews.

The U.S. Patent and Trademark Office tribunal said Intuitive “demonstrated a reasonable likelihood” it could prove claims in P Tech LLC’s 9,149,281 and 9,192,395 patents were obvious in light of prior art and therefore invalid. The patents involve a method and apparatus for securing body tissue with a robotic mechanism.
