Intel Joins Mylan, Apple in Seeking High Court Eye on PTAB Rule

Intel Corp. wants the U.S. Supreme Court to tell the Federal Circuit it must allow appeals of a much-debated U.S. Patent and Trademark Office rule that makes it harder to initiate patent challenges.

Intel’s petition for review in an ongoing dispute with patent owner VLSI Technology LLC comes on the heels of similar petitions filed by Mylan Laboratories Ltd. and Apple Inc. The companies are challenging the agency’s Fintiv rule, which allows the Patent Trial and Appeal Board to deny review based on the state of a parallel infringement case.
