Insulet Trade Secrets Claims Duck Time-Bar Challenge for Now

Insulet Corp.'s trade secret case against EOFlow Co. over insulin-pump technology requires a jury to decide whether it was brought too late, a Massachusetts federal court said.

EOFlow argued the three-year statute of limitations started by at least 2018, when Insulet first suspected the EO Patch 2 pump used its proprietary information, a standard rejected by the US District Court for the District of Massachusetts in an opinion Thursday. The court found Insulet’s argument—that it needed to inspect EOFlow’s device but couldn’t reasonably have acquired one before 2022—sufficient to raise a question for a jury.
