Influencer Sues Underwear Company Empowered By You Over Deepfake

An influencer is suing underwear brand Empowered By You for allegedly posting an explicit, AI-generated “deepfake” video online which she didn’t sign off on.

Molly Tranchin, known online as “FashionVeggie,” accused EBY of altering a video she generated under a contractual agreement between the parties and posting the “offensive” imagery to the brand’s Instagram page. The influencer, who describes herself as a family-friendly, body-positive content creator, filed her complaint Tuesday in the United States District Court for the Northern District of California.

The edited video, an act of non-consensual pornography, violated the contract, infringed copyrighted content owned by Tranchin, aided and abetted disclosure of a non-consensual deepfake, and hurt her public image that has amassed over 400,000 followers on Instagram, the complaint alleges.

EBY didn’t respond to a request for comment.

The two parties had executed multiple contracts beginning in May 2024, the complaint said. A contract from September 2025 between EBY and Vrai Digital LLC, which represented Tranchin at the time, detailed an agreement for the influencer to create user-generated content for the underwear brand to use for marketing and promotional purposes in exchange for a flat fee, the complaint said.

User-generated content is any form of content created by consumers rather than brands, the complaint said. This content can feel “more authentic and relatable” than traditional methods, which “affects purchasing decisions.”

Tranchin sent EBY her UGC around October 2025, which was “decent and body positive,” depicting the influencer “wearing tasteful, non-sexual versions of EBY’s products while modestly covering her chest” with her arms, the complaint said. EBY later posted an altered video exposing her breasts through one of the brand’s sheer bras, the complaint alleges.

The agreement included a stipulation that EBY was allowed to make one round of reasonable edits to the content and submit feedback to Tranchin to revise accordingly, the complaint said.

“The contract does not permit EBY to unilaterally alter the UGC without review and approval,” by Tranchin, the complaint alleged. Tranchin says the contract gives the influencer ownership of the content she generated, including all copyrights and other intellectual property rights.

Tranchin is seeking permanent injunctive relief mandating that EBY delete all copies of the video and remove it from public postings; actual, statutory, and punitive damages; costs and attorneys’ fees; and pre-and-post judgment interest.
