IMDb Thwarts ‘DMDb’ Company’s Bid to Invalidate its Trademarks

IMDb.com successfully thwarted a bid to cancel its trademarks for non-use on some claimed services by a competitor trying to register “DMDb.”

The online entertainment company zuMedia Inc. failed to assert facts to support it’s “conclusory” claim that the online entertainment database never used its mark on certain products, said Judge Vernon S. Broderick of the US District Court for the Southern District of New York. zuMedia also failed to rebut an argument by theAmazon.com Inc.-owned company that IMDb had used the marks with the goods at issue, the court said as it granted IMDb’s partial motion to dismiss. ...
