Illinois Hospital Narrows Privacy Suit Over Health Info Sharing

Illinois-based Sarah D. Culbertson Memorial Hospital convinced a federal court to partially dismiss a proposed class action accusing it of sharing sensitive health data with tech companies, limiting the plaintiff to negligence claims.

The plaintiff’s Electronic Communications Privacy Act claims failed for a number of reasons, including that she failed to say how her personal health data specifically was disclosed, as opposed to that of a class member more generally, the US District Court for the Central District of Illinois said Wednesday. Those and other federal and state claims were dismissed with leave to amend.
