Avinash Nagavilli, CEO and owner of HulkFit Products Inc., is freed from a trade dress infringement suit after a Texas federal court ruled that CAP Barbell Inc. failed to establish jurisdiction regarding its individual claims against him.
Judge Lee H. Rosenthal of the US District Court for the Southern District of Texas wrote Monday that CAP sufficiently pleaded a trade dress infringement case against HulkFit and other weight plate makers. The court ruled that CAP presented enough information about the arbitrary, incidental, ornamental, or otherwise nonfunctional parts of its products to advance the case.
