HP Enterprise, IBM Counterclaims Survive in Patent Lawsuits

VirtaMove Corp. must face counterclaims from Hewlett Packard Enterprise Co. and IBM Corp. seeking a court’s judgment one of the patents it accused them of infringing is unenforceable because VirtaMove didn’t disclose certain information to the US Patent and Trademark Office to obtain it.

HPE and IBM gave enough facts at this stage for their inequitable conduct counterclaims to move forward, Chief Judge Rodney Gilstrap wrote in a memorandum opinion and order filed Monday in the US District Court for the Eastern District of Texas.
