The Fifth Circuit on Monday vacated a preliminary injunction that prohibited a community-college focused honor society from engaging in several forms of online speech targeted at its competitor, Phi Theta Kappa Honor Society.
The injunction against HonorSociety.Org Inc. is overbroad and impermissibly compels speech, according to an unpublished opinion filed in the US Court of Appeals for the Fifth Circuit. The injunction required Honor Society to include a disclaimer on any website or social media post that referenced the parties’ pending trademark litigation.
