The creator of the viral “Honey Badger Don’t Care” video will get another chance to bring his trademark infringement claim against a greeting card maker to trial, the U.S. Court of Appeals for the Ninth Circuit ruled.

Comedian and actor Christopher Gordon, who performs under the name “Randall,” posted a video on YouTube in 2011 depicting a honey badger in action with sarcastic and camp voiceover comments.
