Home Depot Denied Quick Exit from Paint Seller’s Trademark Suit

Home Depot Inc. failed to escape claims that it infringed a chrome paint company’s trademarks by featuring a branded product page on its website, a California federal court ruled.

Alsa Refinish LLC plausibly alleged that consumers would be confused by the existence of an “Alsa Refinish” page on the home improvement retailer’s website, the US District Court for the Central District of California said in an opinion Wednesday. Even though the page indicated Alsa products to be currently unavailable, consumers could falsely perceive an association, the court said as it denied Home Depot’s motion to dismiss.
