A homeowners’ association management company lost its bid to have the Fifth Circuit overturn a $100,000 damages award Tuesday stemming from a lawsuit by a rival company that prevailed in a dispute over an infringing domain name.
Spectrum Association Management of Texas LLC sued Lifetime HOA Management LLC and Jay Tuttle, a former director of business development at Spectrum who left the company in April 2015. Tuttle helped form Lifetime, which offered the same services in the same area of San Antonio, after leaving Spectrum.
Lifetime used the domain name Spectrumhoamanagement.com, and visitors to that site landed on Lifetime’s webpage. ...
