A Republican politician from Maryland’s Eastern Shore has been enjoined from using campaign signs that resemble the trademarks of the Hershey chocolate company, the District of Maryland ruled (Hershey Co. v. Friends of Steve Hershey, 2014 BL 197820, D. Md., 1:14-cv-01825-WDQ, 7/17/14).
The court granted July 17 Hershey Co.'s request for a preliminary injunction, finding that campaign posters displayed by supporters of a Maryland politician constituted a use in commerce of a design that was likely to create confusion with the Hershey Co.'s trademarks.
