Hershey Settles ‘Tough Cookie’ Lawsuit With Cookie Department

The Hershey Co. and ONE Brands LLC agreed to settle a Berkeley-based cookie company’s “Tough Cookie” trademark infringement lawsuit in California federal court.

The Cookie Department Inc. sued Hershey and its subsidiary ONE for infringing its registered Tough Cookie trademark in protein bar packaging that included “Tough Cookies Only.” The trademark claims survived a bid for summary judgment dismissal in September, and an amended motion for summary judgment was pending in the US District Court for the Northern District of California.

Terms of the settlement weren’t available, and counsel for both parties didn’t respond to a request for comment.
