Hershey is the exclusive worldwide licensee of the Jolly Rancher trademarks, and has used these marks for candy and confectionery products since at least 1950, according to the complaint. In January, Hershey’s sent a claim letter to SSY E Juice Inc., doing business as Vap-O-Rama, accusing the company of infringing these marks through the manufacture and sale of Blue Jolly vape juice.
