Heineken’s La Tropical Advances Beer Trademark, Copyright Claims

A Heineken NV unit moved trademark and copyright claims forward after a Florida judge’s mixed ruling on a California brewer’s bid to toss the lawsuit centered on palm tree beer branding.

Cerveceria La Tropical fended off challenges to its claims that its logo doesn’t infringe Soltura LLC’s registered trademark and that the registration should be canceled. Soltura also failed to escape the claim that it’s logo infringes the copyright of La Tropical’s, though it convinced the US District Court for the Southern District of Florida to ax La Tropical’s false advertising and unfair trade practices claims.
