Heineken USA Inc. sued a Texas company it said imported and sold beer with labels “blatantly infringing” the trademarks of its Indio and Carta Blanca brands in at least three states.
Oz Trading Group Inc. hired a consultant to submit applications to the US Department of Treasury to obtain certifications for labels that copy “nearly every element” of the Heineken product labels’ protected designs, according to a complaint filed Tuesday in the US District Court for the Southern District of Texas. It alleges trademark counterfeiting, infringement, and unfair competition claims under the Lanham Act.
