Halliburton Wins Axing Rival’s Fracking Patents Upheld on Appeal

The Federal Circuit upheld an administrative tribunal’s cancellations of four electric-fracking patents held by a unit of ProFrac Holding Corp., including two asserted against Halliburton Co. in a since-settled lawsuit.

There was no error in the Patent Trial and Appeal Board’s determination that “high pressure"—a term in all proposed substitute claims US Well Services LLC had requested for invalidated US Patent Nos. 10,280,724 and 10,254,732—is indefinite, Judge Alan David Lourie wrote in an opinion issued Thursday by the US Court of Appeals for the Federal Circuit.
