The Patent Trial and Appeal Board erred when it analyzed a guitar pedalboard patent and found an earlier electrical relay patent couldn’t be analogous prior art, the Federal Circuit said Monday.
Pro Stage Gear LLC owns U.S. Patent No. 6,459,023, covering a board that houses and connects guitar effects pedals. Donner Technology LLC argued the patent was invalid as obvious based on an earlier patent that discloses an improved electrical relay structure.
The PTAB rejected Donner’s challenge because the relay wasn’t analogous prior art to the pedalboard.
