Gucci America Inc. convinced a federal judge to adopt a magistrate judge’s recommended $1.3 million counterfeit award against the remains of bankrupted department store Lord & Taylor.
The magistrate judge’s findings that Lord & Taylor Ecomm LLC infringed the Gucci word trademark and interlocking G logo contained no clear error, according to the Oct. 17 opinion filed in the US District Court for the Southern District of New York. Judge Lorna G. Schofield held Lord & Taylor in contempt but declined Gucci’s request to enhance damages by $10 million because it came too late.
