Guardant Health Patent Case Heads to November Trial in Delaware

Guardant Health Inc.’s patent infringement case against Foundation Medicine Inc. over cancer testing technology is heading to trial in Delaware federal district court next month, after twice being delayed.

Judge Leonard P. Stark, the chief judge of the U.S. District Court for the District of Delaware, set a Nov. 30 trial date in an Oct. 16 order. Foundation Medicine had urged the judge to postpone until at least 2021, due to the coronavirus.

The “court believes it can conduct a jury trial safely—by making certain modifications to its ordinary procedures—while also providing the parties a fair trial,” Stark wrote. ...
