Grubhub Fails to Axe Trademark Suit Brought by Restaurant Owners

Food-delivery company Grubhub Inc. failed to escape claims brought by nine restaurants that it stole their trademarks and engaged in false advertising by adding the restaurants to its platform without permission.

Judge LaShonda A. Hunt of the US District Court for the Northern District of Illinois, however, granted Grubhub’s motion to dismiss as to false-association claims from seven of the plaintiffs, writing in an opinion Tuesday that they didn’t adequately specify the trademark interests they were alleging were violated.
