Groupon Must Defend Patent Suit Over Online Incentive Technology

The Federal Circuit revived a lawsuit against Groupon Inc. by an owner of a patent on online incentive programs.

Kroy IP Holdings, a company tied to inventor and patent monetization executive York Eggleston, convinced the appeals court that administrative decisions regarding US Patent No. 6,061,660shouldn’t have been relied on by a federal judge in Delaware to kill Kroy’s district court suit. The company argued rulings at the Patent Trial and Appeal Board invalidating parts of the ‘660 patent were improperly applied in the Delaware case to knock out other claims never considered by the PTAB.
