‘Grabba Leaf’ Trademarks Canceled as Descriptive (1)

The owner of ‘Grabba Leaf’ trademarks tried to get a ‘Hot Grabba Leaf’ mark canceled, but lost his own instead.

Hot Grabba Leaf LLC convinced the Trademark Trial and Appeal Board to nix Michael A. Robinson’s ‘Grabba Leaf’ marks, because they merely described a product, in an April 25 precedential decision.

Robinson had asked the U.S. Patent and Trademark Office to nix the 2012 ‘Hot Grabba Leaf’ mark since he’d sold tobacco leaf cigar wraps under that label since 2009. Hot Grabba Leaf responded by moving to cancel Robinson’s mark, and successfully axed the basis for Robinson’s challenge.
