The Patent and Trademark Office wants the U.S. Supreme Court to save a law banning federal registration of scandalous and immoral trademarks.
The office has filed its appeal in Iancu v. Brunetti, opposing a ruling allowing fashion designer Erik Brunetti to register his “Fuct” fashion brand as a trademark.
The Fuct trademark meets the requirement of a scandalous and immoral mark, which is prohibited under federal trademark law, it said. A federal appeals court was wrong to apply the U.S. Supreme Court’s decision allowing disparaging trademarks to the Brunetti case, the PTO argued in its Sept. 7 filing.
