Gorilla Mind LLC filed a trademark lawsuit accusing Gorilla Drinks Ltd.'s energy drinks of infringing its own brand’s and arguing its dietary supplements trademarks give it priority.
Cans of “Gorilla Energy Drink,” first sold in the US in December, have already caused rampant, demonstrable consumer confusion, Gorilla Mind said in a complaint at the US District Court for the Central District of California. Both brands use bright colors and a bold gorilla face graphic along with Gorilla as the primary word element on the same size can, often displayed in stores right next to each other.
