Google Narrows VirtaMove Software Patent Lawsuit in California

Google LLC convinced a California federal judge to dismiss some allegations in VirtaMove Corp.’s computer software-patent dispute, though the central claim of direct infringement survived.

‘Failed negotiations between VirtaMove and Google aren’t enough to establish induced infringement based on pre-suit knowledge, Judge Noel Wise ruled Nov. 28 in the US District Court for the Northern District of California, partially granting Google’s motion to dismiss.’ Wise also ruled VirtaMove didn’t sufficiently allege how Google conducted contributory infringement. The mixed ruling, however, rejected Google’s argument that Virtamove didn’t sufficiently allege direct infringement and that one asserted patent wasn’t eligible for patent protection. ...
