Google Defeats Suit Over Use of ‘Edible Arrangements’ Trade Name

Google LLC beat a Georgia lawsuit asking it to pay to use the trade name “Edible Arrangements” in its keyword advertising program, after the state’s top court said Tuesday that state law doesn’t make Google’s conduct unlawful.

Edible IP LLC failed to state claims for civil theft, conversion, or “money had and received” arising out of Google’s use of its trade name, because it didn’t allege consumers would be confused by Google’s actions, the Georgia Supreme Court said.
