‘GOLO’ Can’t Block ‘Goli’ During Health Product Trademark Suit

GOLO LLC failed to convince a federal court to make Goli Nutrition Inc. stop using its trademark in the midst of a lawsuit between the weight management product companies.

GOLO didn’t demonstrate a likelihood that the two marks would confuse consumers or that it would suffer irreparable harm if Goli continued using its trademark, the U.S District Court for the District of Delaware said.

The trademarks share three common letters and a similar sound but look entirely different and appear on separate products offered to distinct consumers, the court ruled in denying a preliminary injunction.
