Getty’s AI Copyright Suit Survives Stability’s Bid for Dismissal

Stability AI Ltd. lost its bid to dismiss the majority of Getty Images (US) Inc.'s lawsuit accusing the AI-image generator of copying more than 12 million photographs without permission in order to train its models.

Judge Trina L. Thompson of the US District Court for the Northern District of California found Thursday that Getty’s copyright and trademark infringement, unfair competition, and and trademark dilution all were sufficient to move forward.

Getty adequately alleged a likelihood of confusion and that its mark had attained “household” status such that its trademark infringement and dilution claims were sufficient to survive dismissal, Thompson said. ...
