Getty Images Didn’t Offend Right of Publicity When It Displayed, Offered to License Photos

Online stock photo service Getty Images (US) Inc. did not offend an individual’s right of publicity under Illinois law when it displayed and offered to license the individual’s photograph for editorial purposes, the U.S. District Court for the Northern District of Illinois held July 1 (Thompson v. Getty Images (US) Inc., N.D. Ill., 1:13-cv-01063, 7/1/13).

Judge Matthew F. Kennelly granted the service’s motion to dismiss, holding that the plaintiff—the last surviving member of a well-known rhythm and blues singing group—failed to state a claim under the Illinois Right of Publicity Act, 765 ILCS 1075/30.
