The maker of the popular Furbo pet-monitoring and treat-delivery system convinced the Federal Circuit it didn’t infringe a Washington inventor’s patent.
The US Court of Appeals for the Federal Circuit on Thursday affirmed a district court’s ruling that Tomofun LLC’s Furbo operates differently from the system described in a patent owned by DoggyPhone LLC that it was accused of infringing in a 2019 lawsuit. The three-judge panel agreed that the Furbo device and the “Internet Canine Communication System” claimed in US Patent No. 9,723,813 differed in at least one important respect.
