Polaroid raised credible questions about a potential contradiction in Fujifilm’s legal position. The court said that Fujifilm wants “to benefit from the protection of a design patent for its Instax Square film while contending that Polaroid’s near-identical design is entirely functional and unworthy of protection,” according to a Monday order in the US District Court for the Southern District of New York.
