Most of a jury’s findings of liability for infringement by music download and locker service MP3tunes was reasonable and needn’t be overturned, the U.S. District Court for the Southern District of New York ruled Sept. 29 (Capitol Records, Inc. v. MP3tunes, LLC, 2014 BL 270734, S.D.N.Y., 1:07-cv-09931-WHP-FM, 9/29/14).
But where the jury had found MP3tunes liable for “red flag” or willful blindness liability with respect to third-party websites, the court did step in.
