Ex-Rascals Member Fails to Stop Band Using Name on Reunion Tour

A former member of the rock band the Rascals, Eddie Brigati, lost his bid to stop other members from using the band’s trademark while on a reunion tour, according to a New York federal court.

Brigati, who sang and played percussion for the band known for “Good Lovin,” abandoned his interest in the “Rascals” mark, Judge John G. Koeltl wrote in an opinion for the U.S. District Court for the Southern District of New York. Brigati failed to show his own use of the mark, any likelihood of confusion, and was too delayed in making his claims, Koeltl said.
