Ford’s Challenge to MIT Ethanol Patent Will Get a Board Hearing

Ford Motor Co. will get a second chance to administratively kill two patents at the heart of a Delaware lawsuit against the carmaker.

Ethanol Boosting Systems and the Massachusetts Institute of Technology sued Ford for patent infringement in May 2020, asserting the car company used a fuel management system described in a family of patents including US Patent Nos. 10,619,580 and 10,781,760.

Ford sought to challenge the patents in twin proceedings at the Patent Trial and Appeal Board, but that body refused to take the cases in an April 2021 decision.
