Florida Court Tossed Copyright Case Too Easily, 11th Cir. Says

An author convinced the Eleventh Circuit to revive his copyright infringement lawsuit against a Florida newspaper because the lower court took the paper’s word over his in a dismissal motion.

Benjamin Vient, who represented himself, made plausible allegations that the Highlands News-Sun gave his work to third parties that commercially exploited it, the U.S. Court of Appeals for the Eleventh Circuit said Tuesday.

A lower court had found his claims unreasonable while also criticizing his failure to show for a case status hearing, noting he had filed several similar lawsuits in the last few years.
