Fifth Circuit Upholds Ericsson Win in Patent Licensing Fight

HTC Corp. couldn’t convince the Fifth Circuit it deserved a new trial after Ericsson Inc. was found not to have breached a pledge to offer the smartphone maker fair terms on a license for patents essential to 4G and other industry standards.

Jurors in the Eastern District of Texas found in 2019 Ericsson didn’t breach its obligations to license the patents on terms that are fair, reasonable, and non-discriminatory, or FRAND. HTC argued the judge didn’t provide jurors with enough guidance on some key issues, including how to value the patents.
