An appeals court affirmed a 2022 Delaware jury verdict invalidating thumb drive patents asserted against Ingenico Inc.
Patent owner Ioengine LLC said the point-of-sale firm infringed its patents, but Ingenico countered that the patents were predated and rendered obvious and anticipated by a thumb-drive system called DiskOnKey that was put into public use by Israeli tech company M-Systems. The US Court of Appeals for the Federal Circuit Wednesday rejected Ioengine’s arguments that the DiskOnKey product wasn’t “in public use” and, in any event, should’ve been barred from being presented to the jury.
