Federal Circuit Should Emulate Judge Wallach, Colleague Says

Judge Evan J. Wallach’s penchant for pointing out an attorney’s lack of candor at the start of oral argument will be missed on the Federal Circuit as he takes senior status, his colleague Judge Kathleen M. O’Malley says.

“He was never one to let it go, and with good reason,” she said. “Some of the rest of us are probably too quick to just say, ‘OK, that was a bad thing that affects my view of your credibility, but I don’t need to tell you that here in open court,’ but maybe we should more often.”
