L’Oreal Facing Revived Patent Infringement Suit After Appeal (1)

L’Oreal SA and its US subsidiary L’Oreal USA Inc. will have to again face claims it infringed University of Massachusetts’ patents with a skin moisturizer, after the Federal Circuit gave new life to the suit.

The US District Court for the District of Delaware erred in allowing the French headquarters to escape the suit early and in its claim construction that led to the invalidation of two UMass patents for treating skin with the organic compound adenosine, the US Court of Appeals for the Federal Circuit ruled in a precedential opinion.
