The Federal Circuit reversed the majority of two decisions nixing a biometric security patent and remanded the cases to a US Patent and Trademark Office tribunal for further review.
The appeals court agreed with CPC Patent Technologies’ arguments that the Patent Trial and Appeal Board’s decision invalidating US Patent No. 8,620,039 lacked substantial evidence, according to an unpublished order issued Monday.
The court reversed and remanded most of the claims but dismissed the appeal regarding four others, citing an opinion in a separate case before the appeals court that affirmed their invalidation.
