Federal Circuit Rejects SAP’s Texas Transfer Bid in Patent Suit

SAP America Inc. lost its bid to force a judge in Marshall, Texas, to transfer a patent lawsuit to another East Texas courthouse.

Despite errors in US District Court for the Eastern District of Texas Chief Judge Rodney Gilstrap’s rejection of SAP’s transfer bid, the US Court of Appeals for the Federal Circuit wrote in a precedential opinion Thursday, “SAP failed to show that the denial of transfer was patently erroneous, particularly given that it was SAP’s burden” to demonstrate Sherman, Texas, would be “clearly more convenient” than Marshall.
