Federal Circuit Puts Patent Application Fraud Case on Trial Path

The Federal Circuit unwound a federal judge in Houston’s ruling that a supplier to the oil and gas industry, Tenaris Coiled Tubes LLC, acted fraudulently by withholding information to help it obtain three patents.

The US District Court for the Southern District of Texas axed the Tenaris patents before the application process could be scrutinized at trial based on a one-sided analysis, Judge Leonard P. Stark wrote in a precedential opinion Thursday.
