Federal Circuit OKs Invalidation of Parts of Air Mattress Patent

The owner of an air mattress patent failed to convince the Federal Circuit that an agency tribunal improperly invalidated parts of the patent as indefinite.

The Patent Trial and Appeal Board had agreed with petitioner Intex Recreation Corp. that certain parts of Team Worldwide Corp.'s U.S. Patent No. 9,989,979 claim four functions but don’t disclose sufficient structures to perform them.

The U.S. Court of Appeals for the Federal Circuit affirmed in a nonprecedential opinion after reviewing the patent language, the prosecution history, and expert testimony of both parties.
