Federal Circuit Changes Rules for Attorneys Arguing Remotely

Attorneys who need to argue remotely at the Federal Circuit must show good cause that they or a member of their household has a COVID-19 related medical risk, according to the court’s revised protocols.

The U.S. Court of Appeals for the Federal Circuit altered its procedures for participating in oral arguments remotely, beginning with the June sitting. The attendance, masking, and testing policies for appearing in person are unchanged.

Arguing counsel needing to appear virtually must include a declaration that shows the medical risks underlying the request “with specificity” and the precautionary steps they have taken to avoid potential COVID-19 ...
